Website Hosting & Maintenance Agreement
This agreement is between Starview Data ("we", "us") and you, the client ("you"), and covers website hosting and maintenance services provided under a recurring subscription.
1. What's Included
Your hosting subscription includes:
- Website hosting on Cloudflare Pages — a globally distributed platform with edge locations worldwide, automatic SSL, built-in DDoS protection, and CDN delivery
- DNS management through Cloudflare — your domain pointed and kept working
- Database & storage as applicable to your site — Cloudflare D1 (database) and/or R2 (file storage) provisioned and maintained by us
- Routine maintenance — bug fixes, security patches, and minor updates to keep your site running as intended (see Section 4 for scope)
- Basic monitoring — we watch for downtime and will reach out proactively if we catch an issue
- Weekly backups retained for 30 days
- Customer portal access — view services, invoices, and quotes, and message us at any time
2. Term & Renewal
This agreement runs for an initial term of 12 months from your start date. After that, it automatically renews on a month-to-month basis unless either party gives 30 days' written notice of cancellation (see Section 9).
We'll remind you before your first annual renewal. Annual prepay options, if applicable, will be noted in your quote.
3. Uptime & Availability
Your site runs on Cloudflare's infrastructure, which has an excellent real-world track record. We make reasonable efforts to keep everything running smoothly.
That said — we do not offer a formal uptime SLA or uptime credits. Temporary outages can happen due to Cloudflare platform issues, DNS propagation, or factors completely outside anyone's control. You can check live platform status at cloudflarestatus.com.
If your site goes down and we can fix it, we will — fast. If it's a Cloudflare infrastructure issue, we'll keep you updated while Cloudflare resolves it.
4. Maintenance Scope
Maintenance included in your subscription covers keeping your existing site working — bug fixes, compatibility updates, security patches, and minor content corrections.
It does not include new features, redesigns, new pages, integrations, or anything that involves building something new. That work is scoped and quoted separately as a consulting engagement, billed at our current hourly rate.
If you're unsure whether something falls under maintenance or consulting, just ask — we'll tell you upfront before doing the work.
5. Support
Reach us through your customer portal or at [email protected].
- Standard response: within 2 business days (Mon–Fri, excluding holidays)
- Site down / critical issue: within 4 business hours during business hours — flag it as urgent in your message
We don't offer 24/7 emergency support, but we do take site-down situations seriously and respond as quickly as we can.
6. Backups
We maintain weekly backups of your site files and database, retained for 30 days. If something goes wrong on our end, we'll restore from the most recent backup at no charge.
We strongly recommend keeping your own copy of any content critical to your business. We're not liable for data loss caused by Cloudflare platform failures or third-party outages.
7. Billing & Usage Costs
Hosting is billed monthly, quarterly, or annually depending on your plan. Payments are processed through Stripe.
If a payment fails, we'll notify you and retry for up to 7 days. After that, your service may be suspended. Suspended sites are kept for 30 days, then may be permanently removed.
Usage flex: Your plan is based on typical small-business traffic and storage levels. If your site's traffic or storage grows substantially — meaning Cloudflare's underlying costs to us increase meaningfully — we reserve the right to adjust your hosting rate with 30 days' advance notice. We won't do this without a good reason, and we'll explain exactly what changed.
Price increases at renewal will always be communicated in advance and won't take effect mid-cycle.
8. Acceptable Use
Your hosted site must not be used to:
- Publish or distribute illegal content of any kind
- Send unsolicited email (spam) or operate a bulk email service
- Infringe on copyrights, trademarks, or other intellectual property
- Engage in phishing, fraud, or deceptive practices
- Host content that violates Cloudflare's acceptable use policies
Age-restricted products: If your business sells alcohol, tobacco, cannabis, vaping products, firearms, or any other age-restricted goods, you are solely responsible for ensuring your site complies with all applicable federal, state, and local laws — including age verification requirements, required disclosures, and advertising restrictions. We will assist with technical implementation on request, but compliance is your responsibility.
We may suspend service immediately if these terms are violated.
9. Cancellation
Either party can end this agreement with 30 days' written notice — by portal message or email. You'll retain access through the end of your current billing cycle.
On request, we'll provide a copy of your website files within 14 days of your cancellation date. Your data is yours — we won't hold it hostage.
We may cancel or suspend immediately for unpaid balances beyond 30 days or for acceptable use violations.
10. Your Data & Ownership
You own your content. All text, images, files, and data that you provide or that your site generates belong to you. We don't claim any rights to it.
We won't sell, share, or use your data for any purpose other than operating and improving your hosted services. See our Privacy Policy for details on how we handle personal data.
11. Limitation of Liability
We're a small business doing our best — not a Fortune 500 company. Our total liability for any claim under this agreement is capped at the total amount you paid us in the 3 months prior to the claim.
We're not liable for indirect, incidental, or consequential damages — lost revenue, missed opportunities, or data loss from circumstances outside our control. This includes Cloudflare platform failures, domain registrar issues, or third-party service outages.
12. Changes to This Agreement
We may update these terms from time to time. If we make material changes, we'll email you and post the new version in your portal at least 30 days before it takes effect. Continued use of the service after the effective date means you accept the updated terms.

13. Governing Law
This agreement is governed by the laws of the State of Connecticut. Any disputes will be resolved in the courts of Hartford County, Connecticut.
